Rationale

In an era of globalization, one of the most important areas of study in international and domestic law is the one regarding the legal principles and norms applicable to international business relations. The objective of this course is to study international public law, international private law, and comparative law aspects of international business relations. This course addresses key issues regarding the application of legal norms in foreign investment, the banking system, trade in goods and services, intellectual property, sales transactions, and transportation.

Measurable Learning Outcomes

Upon successful completion of this course, the student will be able to:

  1. Learn fundamental international legal doctrines, norms, and principles applicable to international business transactions.
  2. Consider the importance of comparative law and cross-cultural communication for the resolution of international business transaction disputes.
  3. Make proper interpretations of international norms and apply them to specific cases by considering the global context, in which international business transactions take place and the importance of understanding diverse legal systems and cultures.
  4. Learn the nature of the international legal system, including the functioning of international organizations which regulate and influence international business relations.
  5. Understand the integrative methodology for the legal analysis of international business relations, including the public international law, private international law, and comparative law aspects.
  6. Apply fundamental legal norms and principles to international business transaction issues such as the international trade in goods and services and the international protection of intellectual property.
  7. Apply legal norms and principles of international contracts, including the United Nations Convention on Contracts for the International Sale of Goods to international business transactions.
  8. Understand the key place of ethical norms for the proper functioning of international business relations.
  9. Understand the application of international law to international business relations consistent with the Christian worldview.

Discussions (4) 

Discussions are collaborative learning experiences. Therefore, the student will create a thread in response to the provided promptly for each discussion. Each thread must be 400–500 words and demonstrate course-related knowledge. In the thread, major points must be supported by all the required reading and presentations from the assigned Module: Week. In addition to the thread, the student will reply to at least 2 other classmates’ threads. Each reply must be at least 250 words.

Research Paper Assignment

Research Paper: Thesis Statement and Outline Assignment

The student will write an outline of at least 900 words with major points and a thesis statement of no more than 2 sentences that specifies the subject matter of the Research Paper.

Research Paper: Draft Assignment

The student will write a draft of the Research Paper that is at least 3,000 words. The draft must include an outline, introduction, and thesis statement that is no more than 2 sentences and is incorporated into the introduction, main body, and conclusion as well as a bibliography and at least 15 citations in the current Bluebook format. The word count includes the citations, but not the outline.

Research Paper: Final Assignment

The student will submit his or her final Research Paper of at least 5,000 words with at least 25 citations in the current Bluebook format. The word count includes the citations, but not the outline. Note: LL.M. students must add 2,500 words of writing to their final paper. This is a Pass/Fail component of this assignment. This is not required of the JM students.

Case Brief Assignments (3)

The student will write 3 case briefs of at least 500 words each that according to his or her view are the most influential and interesting cases. Each case brief must be in the current Bluebook format.

Quizzes (4)

Each quiz will cover the Learn material for the assigned Module: Week. Each quiz will be open-book/open-notes, contain a combination of 10 multiple-choice, true/false, and short answer questions, and have a 1-hour time limit.

Quiz: International Business Law in Times of Globalization

The quiz will cover the Learn presentation for Module: Week 1. The quiz will be open-book/open-notes, contain 5 multiple-choice and true/false questions, and have a 25-minute time limit.
